We operate across the UK and deliver internationally.



Delivery & Risk

  • We deliver using a range of trusted courier services — including but not limited to Royal Mail, DPD, DHL, Evri and other reputable carriers — depending on cost, destination, and service availability.

  • Ownership passes only when full payment clears.

  • Risk (loss or damage) passes when goods are delivered to the address, safe place, neighbour or collection point you specify.

  • Requests to leave parcels unattended are at the buyer’s own risk.

  • If a delivery fails or is returned due to refusal or non-collection, we may deduct reasonable re-delivery or storage charges from any refund due.


Payment & Pricing

  • Prices are shown in GBP and include or itemise VAT at checkout.

  • Some vintage or pre-owned items are sold under the UK VAT Margin Scheme (VAT not reclaimable).

  • A binding contract forms only once we send a dispatch confirmation email.

  • Secure payments are handled by Stripe and PayPal.


Returns & Cancellations

You have a 14-day right to cancel most online purchases under the Consumer Contracts Regulations 2013, starting the day after you receive your order.

To return or cancel:

  1. Email returns@mysticmoods.co.uk within 14 days,

  2. Send items back within 14 days of notifying us, using a tracked service.

Returned items must be unused, unaltered and have all tags attached (including the “Not Refundable if Removed” tag).

Refunds include:

  • The product price, and

  • The cost of standard delivery (not express shipping),

    minus any reduction for handling or missing packaging.

Non-returnable items:

  • Bespoke, Made-to-Order or personalised goods

  • Hygiene-sensitive items (earrings, hair accessories, undergarments or items unsealed after delivery)

  • Final-sale or archive-sale items

Refunds are issued within 10 working days of inspection.



Bespoke & Made-to-Order (MTO)

  • MTO garments are created from existing designs and current fabrics and are non-refundable except for a proven manufacturing fault.

  • Bespoke pieces are designed from scratch and require a non-refundable deposit.

    • Cancellations forfeit the deposit.

    • Small hand-made variations (±2 cm) are normal and not considered defects.

  • Alterations by third parties void any warranty for fit.

  • In-studio or at-home fittings follow our Studio Code of Conduct and safety rules.



International Orders

  • We ship to EU customers under the IOSS scheme, with VAT calculated at checkout.

  • For non-EU orders, you are responsible for any import taxes, duties or customs fees.

  • Certain natural materials (e.g., leathers, feathers, shells) may be subject to export restrictions; we may cancel orders that cannot be shipped legally.


Faulty or Misdescribed Products

If you receive a faulty or incorrect item, contact us promptly at returns@mysticmoods.co.uk with your order number and photos.

We will arrange a repair, replacement or refund in line with the Consumer Rights Act 2015.


Your Data & Privacy

  • Mystic Moods Ltd is the Data Controller under the UK GDPR (ICO Registration ZB528394).

  • We use your personal data only to process and deliver your orders.

  • EU data transfers use approved safeguards under GDPR.

1A. Regulatory Compliance & Qualifying Trade

Mystic Moods Ltd operates as a fashion design, apparel and creative manufacturing company specialising in sustainable, pre-owned, made-to-order, bespoke garments, handbags and accessories. All commercial activities are carried on with a view to profit and in accordance with HMRC and Companies House requirements. Nothing in these Terms constitutes tax, legal or investment advice.

UK-wide operations. We operate across the United Kingdom and may offer flexible staffing for fittings, collections or delivery throughout the UK.

 


 

1B. Data Controller & ICO Registration

For UK data protection law (UK GDPR and Data Protection Act 2018), Mystic Moods Limited is the Data Controller.

ICO Registration Number: ZB528394.

We do not actively target EU residents for marketing or services. Orders placed from the EU are processed on a passive, case-by-case basis.


 


 

2. Overview

These Terms & Conditions (“T&Cs”) define the terms on the Mystic Moods Ltd e-commerce website and the rights and obligations of the parties arising from the online purchase and offer for sale.

The products sold on our e-commerce website include: pre-owned, “second-hand,” “vintage,” apparel, made-to-order, bespoke, handbags, and accessories — including one-off, hand-made, machine-made, limited editions and limited-run collections.

For clarity, Mystic Moods distributes the following categories:

  1. Pre-Owned (Vintage/Second-Hand) — items that, by definition, may not have the same characteristics as new products.

  2. Apparel — ready-to-wear or limited-edition garments created and sold under the Mystic Moods Ltd brand.

  3. Made-to-Order (MTO) — garments produced to order based on existing Mystic Moods styles and current fabric stock; non-refundable except for manufacturing fault/defect (online and in-studio).

  4. Bespoke — commissions created from scratch using Mystic Moods fabrics; a non-refundable deposit is required; non-refundable except for manufacturing fault/defect (online, in-studio and at-home).

  5. Handbags & Accessories — adornments and bags crafted by Mystic Moods in the UK and/or with approved workshops abroad.

All fabrics (“Material,” “Fabric”) used to create our Sustainable Products may include deadstock, end-of-roll, remnants, scraps and other sustainable sources. Fibres may include (non-exhaustively): silk, wool, mohair, cashmere, cotton, linen (flax), jute, hemp, sisal, fiberglass, nylon, rayon, polyester, acrylic, spandex, Kevlar, carbon fibres, zylon and vinyon. See section7 (Fabrication & Materials) and section8A (Accessories & Handbags) for details.

Sustainability cross-reference. Our circular approach (deadstock use and restoration) is further described in section7 and section10.

Studio Code of Conduct. In-person services (fittings/appointments) are subject to our Studio Code of Conduct (available on request and on our website).

 


 

3. General Terms

By accessing mysticmoods.co.uk, you accept these T&Cs. Do not continue if you do not agree to all terms stated here.

“We/Us/Our” refers to Mystic Moods Ltd; “You/Your” refers to you as the buyer. Any singular/plural/gender uses are interchangeable.

By visiting and/or purchasing, you agree to be bound by these T&Cs including additional terms and policies referenced or linked. If any term is held unenforceable, the remainder remains in force. The Buyer may not assign or transfer rights without our written consent. No waiver of breach is a waiver of later breaches.

Given the electronic nature of the contract, acceptance is not subject to a handwritten signature. Any Buyer document (including an order) may not prevail over these T&Cs without our prior written agreement.

You may save/print these T&Cs (unaltered). Contact customercare@mysticmoods.co.uk for a copy. The version on our website prevails.

All new features/tools are subject to these T&Cs. Prices may change without notice. We may modify/suspend the service at any time; we are not liable to you/third parties for such changes. If these T&Cs are considered an offer, acceptance is expressly limited to them.

We do not warrant that information on this site is accurate, complete or current. Your reliance is at your own risk. We do not guarantee the service will be uninterrupted, timely, secure or error-free, or that results will be reliable. From time to time we may remove or cancel the service without notice. Except as expressly stated, the service and all products are provided “as is” and “as available”.

In no case shall Mystic Moods Ltd or its officers, employees, affiliates, agents, contractors, suppliers or licensors be liable for any indirect, incidental, punitive, special or consequential damages (including lost profits, revenue, savings, data, replacement costs), whether in contract, tort (including negligence) or strict liability, arising from your use of the service or products.

Consumer Rights Act 2015 notice. Nothing in these Terms affects your statutory rights.

Regulatory alignment. These T&Cs are intended to comply with the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Rights Act 2015, UK GDPR/Data Protection Act 2018 and PECR, and the Electronic Commerce (EC Directive) Regulations 2002.

 


 

4. Changes To These Terms

You can review the most current version at any time on this page. Continued use after changes constitutes acceptance.

 


 

5. Online Store Terms

You confirm you are 18 years or older (or you are the age of majority in your jurisdiction) or have the consent and supervision of a parent/guardian.You confirm you are at least the age of majority in your jurisdiction (or have parental consent for minors using the site).


You must not use our products for illegal/unauthorised purposes or violate laws (including IP). You must not transmit malware. Breach may result in immediate termination.

We reserve the right to refuse any order and to limit/cancel quantities per person/household/order (including those with the same account, card, billing or shipping address). If we change or cancel an order, we may notify you via the email, billing address or phone number provided.

Prices shown at checkout apply when you confirm the order. Prices exclude postage and customs taxes/duties; you are responsible for those. Delivery costs are in addition to the product price and shown on the order summary and confirmation email. Price changes do not affect accepted orders.

You may add items to cart, then enter accurate contact and delivery details. By clicking Check Out, you confirm you have read/accepted these T&Cs, are authorised to use the chosen payment method and have sufficient funds. The order is final upon payment. You agree to provide current, complete and accurate account information.

Payment is online via PayPal or Stripe (128-bit SSL). Only the payment provider holds confidential banking data. If payment is refused, the order is automatically cancelled and you will be informed.

A printable/recordable order summary will display after payment.

 


 

5A. Pricing, VAT & Contract Formation

 


Prices are in GBP. If VAT applies, it will be itemised at checkout or on your invoice. Certain pre-owned items may be sold under the UK VAT Margin Scheme; VAT on these is not reclaimable.

A binding contract forms only when we dispatch your goods and send a dispatch confirmation email. We may correct pricing or availability errors prior to dispatch and may cancel any order placed at a price which is an obvious and unmistakeable error.

 


 

5B. Promotions, Gift Cards & Samples

 


Promotions cannot be combined unless stated. Gift cards/store credits are non-refundable, not exchangeable for cash and expire 12 months from issue. Samples and archive-sale pieces are sold as described and may show minor imperfections consistent with their grading.

 


 

6. Products Terms

We aim to display colours/images accurately, but we cannot guarantee your monitor’s display. Product impressions may vary.

Products offered online are those available at viewing time.

  1. Pre-Owned Products — pre-owned/second-hand/vintage items that may not have the same characteristics as new.

  2. Sustainable Products — including one-off, hand-made, machine-made, limited editions and limited runs sold under the Mystic Moods Ltd brand.

Many products are available exclusively online, may have limited quantities, and are subject to the returns policy herein. We may limit sales by person/region/jurisdiction and limit quantities. Descriptions and prices may change without notice. We do not warrant that any product or service will meet your expectations.

 


 

7. Fabrication & Materials Terms

Mystic Moods Products (including one-off, hand-made, machine-made, limited editions, limited runs) may use deadstock/end-of-roll/remnants/leftovers/overstock materials. These may not present the same characteristics or quantities as new fabric. The Buyer acknowledges this and shall not contest on that basis.

Fibres may include natural, regenerated and synthetic fibres (e.g., silk, wool, mohair, cashmere, cotton, linen, jute, hemp, sisal, fiberglass, nylon, rayon, polyester, acrylic, spandex, Kevlar, carbon fibres, zylon, vinyon). Using deadstock helps minimise environmental impacts while conserving resources.

Clarification (Materials & Sustainability). Because fabric sourcing is central to our practice, we use a wide range of fibres, including synthetics (e.g., polyester). Where a specific fibre/content is not listed on a product page, we accept no liability for omission of composition details, and do not represent that any product is “sustainable” solely by virtue of composition. Statements here apply equally to Apparel, Accessories and Handbags.

 


 

7A. Environmental & Ethical Transparency

We prioritise responsible use of materials (including deadstock/surplus) and ethical production partners where practicable. We do not claim certification-based environmental attributes unless expressly stated. Full supply-chain traceability is not guaranteed. These statements avoid greenwashing and do not create a warranty as to sustainability or origin.

 


 

8. Product Manufacturing & Supply Chain Terms

Our Sustainable Products are manufactured in-house and/or outsourced within the UK or internationally. Although we seek aligned suppliers and manufacturers, Mystic Moods Ltd is not liable if any part of our supply chain fails to perform or engages in ethical/sustainability mispractice. We cannot guarantee that all manufacturers, suppliers or distributors will hold true to our values. We continually work to educate our supply chain.

 


 

8A. Accessories & Handbags Terms

8A.1 Definition. “Accessories” include jewellery, scarves, belts, hats, hair adornments and embellishments. “Handbags” include clutches, purses, totes and other bag styles.

8A.2 Sourcing & Manufacture. Components may be sourced from the UK and internationally (including ethical, recycled and deadstock materials, and new materials where required). Items may be crafted/finished in the UK and/or produced with approved external workshops abroad. While due care is taken, we are not liable for variations in production or acts/omissions of independent manufacturers.

8A.3 Materials & Composition. Accessories/handbags may include pearls (natural/cultured), glass, recycled/new metals, gemstones, leathers or vegan alternatives, textiles and mixed media. Natural variation in colour/finish/texture is normal and not a defect. We cannot be held accountable if certain elements are not traceable or derive from non-sustainable sources. We are not liable for allergic reactions, sensitivities or injuries arising from wear, misuse or modification.

8A.4 Safety & Age Restriction. Not toys; not intended for children. Small parts may pose choking hazards. The Buyer assumes full responsibility for supervision and safe use. We place only safe products on the market and comply with applicable product-safety laws, including the UK General Product Safety Regulations and retained REACH restrictions for jewellery and accessories (e.g., nickel/lead/cadmium limits).


8A.5 Care, Use & Modifications. Store cool/dry away from sunlight/moisture. Avoid chemicals, perfumes and oils. Repairs/modifications without our written authorisation void any warranty/rights to claim defects.

 


 

9. Disclaimer Terms

Mystic Moods Ltd sells two types of products:

• Pre-Owned Products: pre-owned/second-hand/vintage. These are not new and cannot offer the same features as new products. The Buyer acknowledges the pre-owned nature, condition and use.

• Sustainable Products: made using the materials described in section7. The Buyer acknowledges the nature, condition and use of such fabrics.

 


 

10. Restored Products Disclaimer Terms

Where possible we restore our Pre-Owned Products to increase product lifespan. The condition is noted on each Product Page. The Buyer must review the graded condition on the Product Page or our Grading Condition Chart on mysticmoods.co.uk.

 


 

11. Payment Terms

All payments are processed per section5. Cardholders are subject to validation checks and authorisation by the issuer. If your issuer refuses authorisation, we are not liable for delay or non-delivery. By accepting these T&Cs you consent to such checks. Payment for products and applicable delivery charges is taken in advance.

 


 

12. Delivery & Receipt Of Order Terms

Mystic Moods Ltd retains ownership of products ordered until full payment of the order price, including postal charges, is made.

Deliveries are via a range of trusted carriers — including but not limited to Royal Mail, DPD, DHL, Evri and other reputable providers — depending on cost, destination and service availability.

As delivery is provided by third-party carriers, we cannot be held liable for non-performance/poor performance. Delivery is made within 30 days unless otherwise stated. Any delay should be reported promptly so we can open an inquiry with the carrier. You may cancel after the stated delivery date unless the delay is due to unforeseeable circumstances. Following cancellation/confirmation of loss, a reimbursement will be made to the original payment method (exclusive of any other indemnity). Partial deliveries may occur. Delivery is deemed completed once products are made available by the carrier (as confirmed by tracking). You must check on receipt that products are compliant and complete.

 


 

12A. Risk & Title

 


Title passes only when full payment has cleared. Risk of loss or damage passes upon delivery to the address or safe place nominated by you, or to a neighbour/collection point authorised by you. Requests to leave parcels unattended are at your own risk.

 


 

12B. Failed Delivery / Storage

 


If an order is returned due to failed delivery, refusal, or non-collection, we may deduct reasonable re-delivery/storage charges from any refund due.

 


 

13. International Customers: Tax & Duty (Including EU IOSS)

Mystic Moods Ltd does not cover any taxes or customs duties. You are solely responsible for all taxes/duties that apply to your purchase. If you choose not to pay taxes/duties and a product is returned to us, we will issue only a partial refund (minus any taxes/duties and shipping costs incurred in receiving the product back).

EU VAT / IOSS. For EU orders, we use IOSS to calculate VAT at checkout where applicable (Registration Country: Estonia; IOSS Number: IM2330031103). For orders outside the EU, import VAT/duties and any handling/clearance fees are your responsibility.

 


 

13A. Export Control & Sanctions

We comply with applicable UK export control, customs and sanctions regulations. We may decline/cancel any order where export/import/embargo/sanctions apply, or where we cannot lawfully fulfil the order.

 


 

13B. International Compliance & Restricted Materials

• Certain materials (e.g., exotic leathers, feathers, shells) may be subject to CITES or other import/export restrictions.

• Certain items may be restricted by the UK Ivory Act 2018, REACH limits for nickel/cadmium/lead in jewellery, and wildlife legislation concerning feathers/shells.

• We may refuse or cancel orders that cannot be lawfully supplied or shipped.

• Buyer responsibility: You are responsible for ensuring the products you order comply with import regulations in your country and for obtaining any permits/licences required.

Where required for EU consumer-safety rules, we may appoint an EU-based economic operator and adapt labelling to comply with the EU General Product Safety Regulation.


 


 

13C. Local Taxes & Consumer Rights

 

International buyers acknowledge that cross-border purchases may be governed by mandatory consumer-protection or tax laws of their jurisdiction; we will comply where required but do not accept liability for additional import taxes or local charges.

 


 

13D. Insurance & Transit

 

Unless specifically arranged, goods are not insured in transit beyond the carrier’s standard coverage. You may request additional insurance at your cost prior to dispatch.

 


 

14. Returns – General Terms (Pre-Owned and Sustainable)

All products must be returned in their original condition within 14 days of receipt, with all tags attached and, where applicable, in branded packaging.

We cannot issue refunds or exchanges for items that show signs of wear, are returned outside the 14-day window, or are without their original tags. All products must have the “Not Refundable if Removed” tag visible. If missing, we will notify you and ask you to arrange shipping back at your cost. We are not liable for these items while stored at our warehouse; if not collected within 14 days, items may be donated.

If we suspect an item has been worn/tampered with or returned without the security seal, we may refuse the return.

Refund timing. Refunds are processed within 10 days of receiving the returned product(s) and credited to the original payment method. We do not refund enhanced/express delivery or customs/return costs unless the item is faulty.

Your right to the outbound “standard delivery” refund under CCR. If you cancel under section15 within 14 days, we will refund the product price and the cost of our standard outbound delivery (if charged). Enhanced/express delivery is not refunded. You are responsible for return postage unless the item is faulty or mis-described.

Diminished value. We may deduct from your refund any reduction in value resulting from handling beyond what is necessary to assess the goods.

Health-sealed goods / hygiene. For health and hygiene reasons, sealed goods (including earrings, hair accessories, undergarments, face/skin-contact items and similar) are non-returnable once unsealed or the hygiene seal is broken, except where faulty.

How to return. Email returns@mysticmoods.co.uk within 14 days of receipt, stating your order number and reason. Items must be sent back within the 14-day window via a tracked service paid for by you. Returned items must be re-saleable and have the security tag visible. Mystic Moods does not offer exchanges. All sale items are final sale and non-refundable.

Return address and risk. Send returns to Mystic Moods Ltd, 16 Fir Tree Road, RG5 4FJ, United Kingdom. Use a tracked/insured service. You bear the risk until we receive the parcel.

Price errors. We may cancel any order placed at a price that is an obvious and unmistakeable error.

 


 

15. Cancelling An Order – Pre-Owned and Sustainable

Under the Consumer Contracts Regulations, you may cancel within 14 days of receiving the product by emailing returns@mysticmoods.co.uk, then return the product within 14 days of cancellation. All cancellations proceed under section14.

Custom-made/MTO/Bespoke exemption. This cancellation right does not apply to custom-made, made-to-order or bespoke products made to your specifications or clearly personalised (see section16).

Once eligible products are received back in original condition with all tags (including security tags), we will refund the price to the original payment method within 10 days of our refund decision (excluding any enhanced delivery costs). Bank/card processing times vary.

Model Cancellation Form. You may cancel by email to customercare@mysticmoods.co.uk If emailing, you may copy/paste:

“I hereby give notice that I cancel my contract of sale of the following goods: [details], ordered on [date] / received on [date], Name, Address, Date.”



 


 

16. Bespoke, Made-To-Order & At-Home Appointments (Non-Refundable; GDPR & Safety)

16.1 MTO. MTO items are produced from available styles using current fabric stock and are non-refundable except for manufacturing fault/defect.

16.2 Bespoke. Bespoke items are created from scratch from available Mystic Moods fabrics. A non-refundable deposit is required and remains non-refundable if you cancel. Bespoke items are non-refundable except for manufacturing fault/defect.

16.3 Legal Basis. These rules are consistent with the CCR exemption for goods made to the consumer’s specifications or clearly personalised. Your statutory rights for faulty goods remain unaffected.

16.4 At-Home / On-Site Appointments.

• You must ensure a safe environment (clear space, adequate lighting, reasonable access). We make reasonable adjustments in accordance with the Equality Act 2010 where practicable—please notify us in advance.

• We accept no liability for pre-existing conditions of the premises or items handled at your request.

• Appointments may be rescheduled for safety reasons or events beyond control (see section23).

• If you fail to attend or are unavailable without at least 24 hours’ notice, any call-out fee or deposit may be forfeited.

• Accessibility & Conduct. Appointments are subject to our Studio Code of Conduct (on request/website).

16.5 Data Handling at Appointments (GDPR).

We may collect measurements, style preferences, images (with consent) and contact details solely to provide the service, create your garment and manage after-care. We minimise data collection, store it securely, and keep it only as long as necessary. Data may be shared with trusted processors (e.g., pattern cutters, ateliers, couriers) for order fulfilment under appropriate terms. You may withdraw consent for non-essential data (e.g., photography) at any time. For access/erasure/rectification, contact customercare@mysticmoods.co.uk (see section19).

Measurement tolerance & alterations. Hand-crafted garments are produced within standard tolerances of ±2 cm. Minor deviations are not defects. Third-party alterations void any warranty relating to fit.

16.6 Early Performance & Loss of Cancellation Right (Services).

If you ask us to begin services (for example, pattern development, fabric cutting, paid consultations or home fittings) within the 14-day cancellation period, you acknowledge we may charge a proportionate amount for work performed up to cancellation. If the service is fully performed within that period at your request, you lose the right to cancel.


 


 

17. Returns – Faulty Products (Pre-Owned and Sustainable)

Provide proof of purchase to return a faulty or mis-described item. You must arrange the return to us. We will inspect items and offer a replacement or refund the full cost of the item (but not the value of any promotional codes used) to the original payment method within 10 days of receiving the faulty item. Processing times vary.

 


 

18. Personal Information

Your submission of personal information through the store is governed by our Privacy Policy.

 


 

19. Data Protection Terms (UK GDPR / DPA 2018 / PECR)

Providing personal information required to sell via the website is obligatory for order processing, delivery and invoicing. Lack of required information may lead to automatic rejection.

Lawful bases & marketing. We process personal data under Contract, Legitimate Interests (e.g., fraud prevention, site security, limited analytics), and Consent (for marketing communications).

Soft Opt-In (PECR). Where permitted, we may email existing customers about similar products; you can opt out at any time.

Security & encryption. Mystic Moods Ltd never has access to your full card data. Only PayPal/Stripe store confidential payment data.

Retention. Order data is retained for at least six years for tax/accounting; optional marketing/photography data is retained only as long as necessary.

Correspondence. Unless otherwise provided, correspondence is by email. Server timestamps/message integrity may constitute proof.

Use & transmission.

• Order management: to confirm, fulfil, ship and support your order and compile statistics; data may be sent to technical service providers solely to perform orders.

• Commercial info: subject to your choices, we may send Mystic Moods and/or partner updates by email/SMS; you can opt out at any time.

 


 

20. Disclaimer Of Warranties; Limitation Of Liability

We do not guarantee that your use of our service will be uninterrupted, timely, secure or error-free; nor that results will be accurate or reliable. You expressly agree your use is at your sole risk. Except as expressly stated, the service and all products are provided “as is” and “as available,” without warranties of any kind (including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement).

 


 

21. Liability Terms (Including Health & Safety Cross-Reference)

Internet. We are not liable for disadvantages or damage inherent in the use of the internet (disruption, external interference, viruses). We are not liable for a breach from unforeseeable circumstances. Without prejudice to the preceding, our total liability shall not exceed the amount paid/payable for the transaction giving rise to such liability.

Authenticity. We conduct proportionate checks to help prevent counterfeit goods. Nothing in these Terms limits your statutory rights where goods are mis-described or not authentic.

Health & Safety cross-reference. For safety, allergy, misuse and age-restriction matters relating to Accessories & Handbags and to At-Home/On-Site Appointments, see section8A and section16.

21.4 Insurance & Risk Disclosure. Mystic Moods maintains public/product liability and professional indemnity cover appropriate to its activities. Clients engaging in fittings or home appointments should ensure their premises insurance covers such activities. We are not liable for indirect or consequential losses, property damage or personal injury except where caused by our proven negligence.

21.5 Third-Party Carriers. When you select your own courier or freight forwarder, delivery and risk transfer occur on collection by that carrier.

Non-excludable liability. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory rights under the Consumer Rights Act 2015 and other mandatory law.

 


 

22. Conformity & Guarantee Terms

We warrant that products are compliant with their intended usage and do not have faults/inherent defects that make them dangerous or unsuitable for normal use other than those mentioned in the Product Description.

 


 

23. Unforeseeable Circumstances (Force Majeure)

Events beyond our control constitute force majeure, including without limitation: floods, fire, storms, lack of raw materials, transport strikes, total/partial strike, lock-out, technical breakdown, stoppage in energy supply, faults in electronic communications networks. We shall notify the other party and minimise damage; obligations resume as soon as possible after cessation.

Carrier suspension. Where carriers suspend services, dispatch and delivery times extend by the duration of the suspension.

Certain content/products/services may include materials from third parties. Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and have no liability for third-party materials or websites.

 


 

25. Prohibited Uses (Website & Social Platforms)

You agree not to use the site for unlawful purposes; solicit unlawful acts; violate laws or regulations; infringe IP rights; harass/abuse/insult/harm/discriminate; submit false or misleading information; seek personal information from minors; upload malware; collect personal information of others; spam/phish/pharm/pretext/spider/crawl/scrape; obscene/immoral purposes; incite hate/violence; publish pornographic/shocking content; disclose others’ personal data; propose unauthorised copies of protected works; promote unsolicited mass messaging; promote criminal activity or instructions; solicit passwords/personal info for illegal commercial purposes; conduct commercial competitions/lotteries/exchanges/ads/pyramids without written agreement; or interfere with/circumvent security features. We may terminate your use for violations.

 


 

26. Hypertext Links & Hyperlinks

Use of links pointing to the Mystic Moods Ltd community is authorised only for promotion, provided the whole website is preserved and there is no risk of confusion. Framing, inline linking and deep linking that reproduces website content without authorisation are prohibited. We may terminate your use for violating the Prohibited Uses.

 


 

27. Compensation Terms (Indemnity)

You agree to indemnify, defend and hold harmless Mystic Moods Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claim or demand, including reasonable attorneys’ fees, arising from your breach of these Terms or violation of law or third-party rights.

 


 

28. Trademarks & Intellectual Property

Mystic Moods Ltd owns the intellectual rights to the website and platforms. Any full/partial copy, extraction or reproduction (including database rights) is prohibited without our prior written agreement. Our trademarks include the Mystic Moods Ltd name and logo; your use of the website does not grant rights to use our marks.

Content & Images. All product photography, look-book imagery, artwork, designs, patterns, copy and audiovisual content are protected by copyright and related rights. Unauthorised reuse, scraping, training, reproduction or public communication is prohibited. You grant Mystic Moods a non-exclusive licence to use reviews or UGC you voluntarily submit, with moderation rights.

Design Know-How & AI Use Prohibition. All designs, sketches, samples, prototypes, digital patterns, grading, tech packs, production methods and creative know-how are proprietary. Copying, reverse-engineering, digitising, scraping or using our content/designs/imagery to train AI models or generate derivative works without our written consent is strictly prohibited.

 


 

29. Third-Party Terms

These T&Cs do not create any right enforceable by any person who is not a party (or any contract made under them), except that provisions may be enforced by our licensors subject to and in accordance with the Contracts (Rights of Third Parties) Act 1999.

 


 

29A. Dispute Resolution (Mediation First)

Before court proceedings, both parties agree to attempt to resolve disputes by good-faith negotiation or independent mediation. This does not limit statutory rights or urgent injunctive relief.

We are not currently subscribed to a specific ADR scheme. If we cannot resolve a complaint through our internal process (see section 33), we will consider ADR or mediation in good faith where appropriate and provide details of any suitable ADR provider upon request.

These Terms and any separate agreements are governed by and construed in accordance with the laws of England and Wales. Any disputes or claims (including non-contractual disputes) are subject to the exclusive jurisdiction of the courts of England and Wales. Nothing herein deprives consumers of rights to bring or defend proceedings in their home state where mandatory consumer protections apply.

These Terms may be presented in more than one language. However, the English version prevails. The contract between us will be concluded in English.

 


 

32. Termination

Obligations and liabilities incurred prior to termination survive termination. These Terms are effective unless and until terminated by either you or us. We use a mix of deadstock, surplus, pre-owned, vintage, and responsibly sourced new fabrics. While we make every effort to confirm material provenance, full traceability and certification cannot always be guaranteed.

Sustainability descriptors such as “deadstock,” “sustainable,” “reclaimed,” or “ethical” are made in good faith to describe sourcing intent and are not legally binding environmental guarantees.

35.4 Compliance with Green Claims Code

Mystic Moods Ltd complies with the UK Competition and Markets Authority (CMA) Green Claims Code and the Consumer Protection from Unfair Trading Regulations 2008.

  • We cannot be held liable for indirect, consequential, or reputational damages arising from reliance on sustainability or environmental claims;

  • Nothing in these Sustainability Terms limits your statutory consumer rights or our liability for fraud, negligence, or misrepresentation.

35.6 Continuous Improvement

We review our sourcing, manufacturing, and environmental impact policies annually or when significant operational changes occur.

Any updates to our Sustainability, Circularity & Ethical Practices Disclaimer will take immediate effect once published on our website.

35.7 Legal & Consumer Rights
