This site is operated by Mystic Moods Limited with the domain mysticmoods.co.uk. We are a registered company in England and Whales under Company Number 14277166. Our registered office is at 5 Greenwich View Place London L14 9NN England. 

The TERMS & CONDITIONS  (hereinafter referred to as “T&C’S”) define the terms on the Mystic Moods Ltd. E-commerce Website  as well as the rights and obligations of the parties arising from the online purchase and offer for sale.

 

The Products sold on our E-commerce Website are ; “pre-owned”, “second-hand” and “vintage”products. And, including but not limited to   “one-off products- made or done as only one of its kind”, “hand-made”, “machine made” ,  “limited editions” and limited runs collections. These products   including but not limited to  clothing apparel and accessories.

The Products distributed on the E-commerce Website by MYSTIC MOODS are divided by two categories;

1. “Products" and “Annular Products” - “pre-owned”, “second-hand” or “vintage” products (hereinafter, the “Products" and “Primary Products”) USED PRODUCTS;

2. “Products" and “Sustainable Products” -  including but not limited to  “One-off products- made or done as only one of its kind”, “hand-made”, “machine made” ,   “limited editions” , limited runs collections —   products sold under the Mystic Moods Ltd Brand — (hereinafter “Products” and “Sustainable Products”)  .

All  fabrics( (hereinafter, the “Material” and “Fabric”) used to create our Sustainable Products include but are not limited too; dead stock fabrics, end of roll fabrics, fabric remnant,  fabric scrap and sustainable fabrics. Given the provenience of these fabrics the properties of these fabrics include but are not limited to; silk, wool, mohair, cashmere (goat), cotton, linen (flax), jute, hemp, sisal, asbestos, fiberglass , nylon , rayon, polyester, acrylic, spandex, kevlar, carbon fibers, zylon and vinyon. GENERAL TERMS

These terms and conditions outline the rules and regulations for the use of Mystic moods Ltd.  - E-commerce Website, located at mysticmoods.co.uk. This website is operated by Mystic Moods Ltd. By accessing this website, we assume you accept these terms and conditions. Do not continue to use mysticmoods.co.uk if you do not agree to take all of the terms and conditions stated on this page.

The Website offers online Products for Sales  (hereinafter, the “Vendors”);Search and purchase of  including but not limited to “pre-owned”, “second-hand” , “vintage”,  “one-off products- made or done as only one of its kind”, “hand-made”, “machine made” , “limited editions” and limited runs collections,  products by internet users (hereinafter, the “Buyer”).The following terminology applies to these Terms and Conditions, "Ourselves", "We", "Our" and "Us"(hereinafter, the “Vendors”) refer to Mystic Moods , "You" and "Your" ,  “ His and Her” (hereinafter, the “Buyer”) to you, the person compliant to the Mystic Moods Ltd Terms and Conditions.  Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

 

By visiting Mystic Moods Ltd.  and/ or purchasing something from us, you engage in our “Terms and Conditions” and agree to be bound by the following terms and conditions (“T&C’S”, “Terms & Conditions”), including those additional Terms and Conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. If any part of these Terms are found to be unenforceable as a matter of law, all other parts of these Terms will not be affected and shall remain in force.  For the avoidance of doubt, should these Terms or any part of them be deemed void or voidable, this shall not affect the validity of any licence provided under these Terms and Conditions.We intend to rely on these written Terms and Conditions for any document expressly referred to in them in relation to the subject matter of any contract between us. "Ourselves", "We", "Our" and "Us"(hereinafter, the “Vendors”) refer to Mystic Moods Ltd. , "You" and "Your" (hereinafter, the “Buyer”). The Buyer and the Vendor will be legally bound by these Terms and Conditions. Words that appear after the expression ‘include’, ‘including’, ‘other’, ‘for example’, ‘such as’ or ‘in particular’ (or any similar expression) will not limit the meaning of the words appearing before such expression. The Buyer  may not assign, sub-license or otherwise transfer any of the Buyer rights under these Terms.Waiver. If you breach these Terms and we choose to ignore your breach, we will still be entitled to use our rights  at a later date or in any other situation where you breach the Terms again.

Given the electronic nature of the contract made by the Buyer and Mystic Moods Ltd, this acceptance is not in any way subject to a handwritten signature by the Buyer.Any written document contained in particular in the documents issued by the Buyer (including the order) may not prevail over these T&C’S without the prior express written agreement of Mystic Moods Ltd.

It is specified, where necessary, that the Buyer may save or print these Terms and Conditions , on the condition nonetheless that they are not modified. The Buyer may contact us at customercare@mysticmoods.co.uk, should the Buyer require a copy of our Terms and Conditions.

The version of the Terms & Conditions  available on the www.mysticmoods.co.uk  website  shall prevail, where applicable, over any other version of these Terms & Conditions,  with the exception of modifications which may be made following acceptance, in accordance with the common law.

All new features or tools which are added to the current store shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Terms (or any part or content thereof).We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. Please read these Terms and Conditions (T&C’S) carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. In no case shall Mystic Moods Ltd.  our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. ONLINE STORE TERMS

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

The prices applicable are those mentioned on the Website at the time that the Buyer confirms his or her order.Furthermore, the Buyer formally acknowledges having been informed that the prices mentioned on the Website do not in any case include, postage,  possible customs taxes and/or duties which the Buyer may be liable for at the time of delivery and of which he or she is the sole debtor.The Buyer is informed that the cost of delivery shall be invoiced in addition to the price of the Products, and that to this end they shall be mentioned specifically on the order summary and the order confirmation e-mail and added to the total price of the order.

At any time and without notice, Mystic Moods Ltd reserves the right to modify the prices displayed.These modifications shall not, nonetheless, have an effect on orders Mystic Moods Ltd has accepted before these modifications come into force.

By browsing the Website, the Buyer has the possibility to navigate easily the various Products offered for sale on the day the Website is visited.  At any time during browsing, the Buyer can secure the Products chosen under the “Add to Cart” heading. Once the Products are secured under the “Add to cart”, the Buyer will be invited to completed a form with the Buyer, his or her,  "You" and "Your" (hereinafter, the “Buyer”) contact details by accurately giving information on the form provided, in particular, the Buyer shall provide an address at which delivery can be made during working hours from Monday to Friday as well as the surname(s), first name(s) and e-mail address.After having read the statement of his or her order, the Buyer will be invited to click on “Check Out” to proceed to payment of his or her order; or to click on “EDIT" to modify the order and/or information about his or her personal contact details.By clicking on “Check Out” during the order process, the Buyer must compulsorily first read and accept these Terms & Conditions. The Buyer warrants that he or she is fully authorised to use the bank card provided for the payment of his or her order and that this bank card has access to sufficient funds to cover all costs arising from the use of Mystic Moods Ltd. services.By clicking on “Check Out" during the order process,  the Buyer declares that his or her, it fully and without reservation accepts all of these Terms & Conditions. The Order will only be final upon payment of the corresponding price.You agree to provide current, complete and accurate  account information for all purchases made at our store.

Payment of the order is carried out on the Internet and must be concomitant to the order, following the instructions given, the Buyer is invited to follow the authentication procedure set up to this end.Mystic Moods uses the secure payment tools  PayPal™ and Stripe. STRIPE and PAYPAL use SSL technology (128-bit encryption) to guarantee a secure transaction when paying by credit card. To make the payment owed, the Buyer will be invited either to provide a bank card number, the date of expiration of this card accompanied, where necessary, by the security code or make the payment directly from his or her PayPal™  account if the Purchaser already has one. The Buyer’s bank details will be asked for each order inasmuch as only the bank chosen by Mystic Moods Ltd.  for the execution of these financial transactions remains in possession of the confidential information.

To this end, the Buyer guarantees Mystic Moods Ltd. that he or she has the authorisation that is possibly necessary to use the method of payment chosen when the order is confirmed.If the bank refuses, the order will be automatically cancelled and the Buyer informed thereof by e-mail.The payment shall otherwise be cancelled and the Buyer may not receive the Products ordered.Once the payment of an order has been made, a printable and recordable summary of the Buyer’s order will be displayed and will specifically mention the order references.

These Online Store Terms are applicable for all Mystic Moods Ltd.  products including but not limited too; (hereinafter, the “Products “, “Annular Products" & “ Sustainable  Products”).

PRODUCTS TERMS

Mystic Moods Ltd. will make  every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. We shall  do our best to ensure that the colour and pattern of the Products whose photos are displayed on the Website are faithful to the original Products.Nonetheless, given the method of presentation of products on the Internet, it is possible that the impression the Buyer has of the photographic representation of the products does not correspond exactly to the product itself.

The Products distributed online on the Website by Mystic Moods are those available in stock on the day the Website is viewed by the Buyer.

The Products distributed on the Website by Mystic Moods Ltd. are divided by two categories;

1. “Products" and “Annular Products” including but not limited too -  “pre-owned”, “second-hand” or “vintage” products (hereinafter, the “Products" and “Annular Products”). These are  available in stock on the day the Website is viewed by the Buyer.The Buyer is informed that the Annular Products are by definition  “pre-owned”, “second-hand” , “vintage” , Therefore  USED PRODUCTS - products which does not have the same characteristics of a new product.

2. “Products" and “Sustainable Products” including but not limited too - “One-off products- made or done as only one of its kind”, “hand-made”, “machine made” ,   “limited editions” , limited runs,  products sold under the Mystic Moods Ltd. brand (hereinafter “Products” and “Sustainable Products”)

Most products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return only.

 

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

 

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations.

PRODUCT MANUFACTURING & SUPPLY CHAIN  TERMS

The Buyer and any third party is strictly informed that our Sustainable Products are manufactured around the world. Our products are manufactured both in house and outsource within the UK or around the world. Although we assure that all textile manufacture, suppliers, distributers (supply chain) upheld our values;Mystic Moods Ltd is not libel if any part of our supply chain  fail to perform, poor perform or non-perform.  In Particular in case of an ethical or sustainable miss practice. Mystic Moods Ltd. cannot in any way be held liable if  miss practice occurs within our supply chain. We cannot guarantee that our  textile manufacture, suppliers or distributers will hold true to our values. The Buyer or any third party may not bring any action against Mystic Moods Ltd. on this basis. We constantly work in educating our Supply Chain about the importance of Sustainability and Fairness.

FABRICATION & MATERIALS TERMS

“Products" and “Sustainable Products” including but not limited too - “One-off products- made or done as only one of its kind”, “hand-made”, “machine made” ,   “limited editions” , limited runs,  products sold under the Mystic Moods Ltd. Brand. Mystic Moods uses materials / fabrics which  include but are not limited too ;  dead stock fabrics, end of roll fabrics, fabric scrap, fabric leftover , overstock fabric , surplus fabric, and fabric remnant.  These fabrics are by definition “scrap fabrics”and  may not present  the same characteristics or quantities as a new fabric. Therefore the Buyer is advise about the material / fabric  working condition and use and shall never contest this point.

The Buyer is informed that  the properties of these fabrics include but are not limited to; Natural fibres(made by nature) and Man Made Fibres (synthetic fibres and regenerated fibres). It is recalled to the Buyer about the nature of these fabrics and the Buyer should never contest these.  We believe that this method is just as environmentally conscious as using only organic and sustainable fabrics. By using deadstock  fabric we minimize the negative environmental impacts while  natural resources and energy.

DISCLAIMER TERMS

It is strictly recalled to the Buyer  that Mystic Moods Ltd operates by selling two types of products referred to in these Terms and Conditions as, including but not limited too; “pre-owned”, “second-hand” or “vintage” products,  “One-off products- made or done as only one of its kind”, “hand-made”, “machine made” , “limited editions” , “limited runs”  products sold under the Mystic Moods Ltd Brand.

All the Annular Products published online on the MYSTIC MOODS Website are “pre-owned”, “second-hand” or “vintage” , USED Products and therefore the products  are not new by definition. It is strictly recalled  that all  Annular Products Products “pre-owned”, “second-hand” or “vintage” cannot offer the same features as a new product.To this end, the Buyer formally acknowledges that he or she has been informed of the "second-hand" nature of the Annular   Products placed online on the Mystic Moods Website and their working condition and use and shall never contest this point.

It is strictly recalled to the Buyer that the Materials /  Fabrics used in the creation of the Mystic Moods Sustainable Products include but are not limited to; dead stock fabrics, end of roll fabrics, fabric scrap, fabric leftover , overstock fabric , surplus fabric, and fabric remnant.To this end, the Buyer formally acknowledges that he or she has been informed about the nature of the fabrics sourced to produce our Sustainable Products placed online on the Mystic Moods Website and their working condition and use and shall never contest this point.

RESTORED PRODUCTS  DISCLAIMER TERMS

Where possible we restore our Annular Products  in order to increase that product life span. The condition of the product  is specifically noted on that item's Product Page. The Buyer is responsible for viewing the Graded Condition of the product in the  item's Product Page or by consulting the Grading Condition Chart found at mysticmoods.co.uk. To this end, the Buyer formally acknowledges that he or she has been informed about the nature of the products  and their working condition and use and shall never contest this point.

PAYMENT TERMS

 

All payments will be processed as set on our ‘ONLINE STORE TERMS” All credit/debit card holders are subject to validation checks and authorisation by the card issuer.  If the issuer of your payment card refuses to authorise payment to Mystic Moods Ltd., we will not be liable for any delay or non-delivery.  By accepting these terms and conditions you consent to such checks being made.  All information provided by you will be treated securely and strictly in accordance with the, Data Protection Act of 2018 and the Data Protection Act of 1998 .Payment for the Products and all applicable delivery charges is taken in advance.

DELIVERY & RECEIPT OF ORDER TERMS

Mystic Moods Ltd.  maintains ownership of the Products ordered until full payment is made of the order price, including postal charges, if owed.The Product(s) shall be delivered to the postal address provided by the Buyer when making his or her order and which will be mentioned on the delivery slip.Delivery shall be made according to the delivery method selected by the Buyer when making his or her order and depending on the country of delivery and the rate outlined in the product description. For most deliveries, the order will be sent to the Buyer by DHL,DPD or Royal Mail.The Buyer shall follow the progress of his or her delivery on the providers website . As delivery is provided by third party service providers, the Buyer is informed that Mystic Moods Ltd.,  cannot in any way be held liable if non-performance or poor performance. The delivery shall be made at the latest within thirty days of the order, except otherwise provided. The Buyer shall be informed of before making his or her order, mentioning an average delivery time period.If there is a delay in delivery any delay in delivery must be reported by the Buyer as soon as possible to mystic Moods Ltd.  which will carry out an inquiry with the carriers concerned.

The Buyer will have the option of cancelling the order after the delivery date mentioned, unless this delay is due to a case of unforeseeable circumstances. As of the exercise of the right of cancellation, or the conclusion of the inquiry made by Mystic Moods Ltd.  confirming the loss of the package, Mystic Moods Ltd. shall make a reimbursement to the bank account debited when the order was made, as soon as possible, to the exclusion of any other indemnity.In the case of the partial delivery of the order, delivery may be made several times, and this right shall only concern the undelivered part of the order.Each delivery is considered to be completed once the Products are made available to the Buyer by the carrier, confirmed by the monitoring system used by the carrier.It is up to the Buyer to check immediately upon receipt of the Product that the dispatched Products are compliant and complete.

INTERNATIONAL CUSTOMERS: TAX AND DUTY TERMS

Mystic Moods Ltd. Does not cove any Taxes/Custom Taxes.

It is  solely  the  Buyers responsibility  to  cover all taxes/duties that apply to his/her purchase. Mystic Moods cannot be held accountable for any taxes/duties charges

Please note: all taxes/duties that apply to your purchase are solely your responsibility.

If you choose to not pay the taxes/duties for any product to be  returned to us,  we will not be able to issue you with a full refund when  we receive the product(s) back.  We will only be able to issue a partial refund — the refund will be issued minus any taxes/duties and shipping costs that we have incurred for receiving the product back.

RETURNS  GENERAL TERMS ANNULAR AND SUSTAINABLE

All  Mystic Moods Ltd. Products must be returned in their original condition within  14 days of receipt with all tags attached and where applicable  in their Branded Packaging.

We're not able to issue refunds or exchanges for items that have clear signs of wear  or  have been returned outside the 14 days returns window or are without their original tags. All products must have visible the  “Not Refundable if Removed ”tag.  We will notify the Buyer if this is the case and ask the Buyer to arrange shipping of the order back to his or her address at the Buyer’s cost. We're not liable for these items while they are stored at our warehouse. If the Buyer does not arrange collection of these items within 14 days  the products will be donated.  All returns must fallow the conditions as stated in these terms.

If Mystic Moods Ltd. suspects that an item has been worn and/or tampered with or returned without the Security Seal (“Not Refundable if Removed” TAG) by Purchaser, MYSTIC MOODS  reserves the right to refuse the return.

All returned products are refunded within 10 days of  receiving the product/ product’s back.  Refunds will be credited to the Purchaser  original method of payment. Please remember it can take some time for your bank or credit card company to process and post the refund too. We will not reimburse the Purchaser for any delivery, custom charges or other costs that  incur in returning the goods to us.

Mystic Moods Ltd. does not offer refunds for  bespoke and custom orders  unless the products have  manufacturing fault or defect. All returns must fallow the conditions as stated in these terms.

The Buyer is responsible for viewing the Return Information on each product page.

To return an item(s) the Buyer must fallow the fallowing conditions;

The Buyer must email us within 14 days of receipt by email at returns@mysticmoods.co.uk with the  relevant order number and reason for return. The order number must  be quoted on all returns.

All returns must be sent to us within the 14 days return window, any items received outside the 14 days window will not be accepted for refund. All returns must be sent via a tracked service and paid for by the Buyer as we do not provide free returns.

The returned item(s) must meet the following conditions;

Products (s) must be in re-saleable condition.

Products (s)  must have visible the “Not Refundable if Removed” TAG.

MYSTIC MOODS does not offer exchanges.

In the case of wanting to return an item, it is your responsibility to do so.

All sale items are final sale and therefore non refundable.

CANCELLING AN ORDER ANNULAR AND SUSTAINABLE TERMS

The Buyer has the  legal right to cancel a Contract (under the Consumer Contracts (Information, Cancellation and Additional Payments) Regulations 2013). All Cancellations will go through our RETURNS & CANCELLATION TERMS —during the relevant period if the Buyer change  his and her  mind or for any other reason  decides that  his and her do not want to keep a Product, the Buyer can notify us within 14 days of receipt, by email at returns@mysticmoods.co.uk of the Buyer’s  decision to cancel the Contract and, provided that the Buyer returns the Product back to us within 14 days of receipt. Mystic Moods Ltd. accepts  a cancellation of an order , all cancelled orders will go through our Returns and Cancellations Terms. When cancelling an order the Buyer will be subject to fallowing our Return & Cancellations Terms.

Advice about the Buyer  legal right to cancel the Contract under these regulations is available from the Buyers local Citizens’ Advice Bureau or Trading Standards office. However, this cancellation right does not apply in the case of Custom Made or Bespoke Products. If the Buyer cancel a Contract his and her must notify us by email at returns@mysticmoods.co.uk within 14 days of receipt. The Buyer must return the product Back to us with the 14 days return window.  Once we have received the Products and provided they are still in the original condition with all tags still attached(including “Not Refundable if Removed” tag) , we will refund the total price payed by the Buyer to the original  payment, within 10 days of our decision to refund the Buyer.    However, we will not cove the cost of deliver for the product to be returned back to us , nor if the Buyer has chose services such as  enhanced delivery.

We only  accept returns within 14 days of receipt for unworn items that have all original tags attached.

It can take time for your bank or credit card company to process and post the refund too.
If more than 15 business days have passed since we’ve approved your return, please contact us at returns@mysticmoods.co.uk.

RETURNS FAULTY PRODUCTS  TERMS  ANNULAR AND SUSTAINABLE

The Buyer should provide us with proof of purchase when seeking to return a faulty or mis-described item. The Buyer will need to arrange for return of the item(s) to us.  We will inspect all items that we receive from the Buyer and   offer to arrange to replace the Product with a new one or reimburse the Buyer for the full cost of the item (but not the value of any promotional code(s) used) to your original payment method within 10 days of receiving back the faulty or mis-described item .

Please remember it can take some time for your bank or credit card company to process and post the refund too.
If more than 15 business days have passed since we’ve approved your return, please contact us at returns@mysticmoods.co.uk.

 

HOW TO RETURN AN PRODUCT TERMS  ANNULAR AND SUSTAINABLE;

Email returns@mysticmoods.co.uk within 14 days of receipt. Please state order number in the subject and the reason for return. We do not cover the costs  for any return delivery, custom charges or other costs that you incur in returning the goods to us. The Buyer is the sole debtor for any costs  incur in returning the goods to us.  Once the return is  received and inspected you will receive a refund  in the item amount, within 10 days from receiving the item back.Time frame on Returns must be respected in order for us to accept the return.

PLEASE NOTE:  Once processed, Refunds can take up to 14 working days to arrive into  to your original method of payment  or PayPal account.
